Terms of Service

These Terms of Service (“Terms”) are an agreement between you — the merchant or user installing or using the Tuneboom application (“Tuneboom”, “we”, “us”) — and Tuneboom. By installing Tuneboom from the Shopify App Store, creating an account, or using the service, you agree to these Terms. If you do not agree, do not install or use Tuneboom.

Tuneboom is a Shopify application that lets merchants sell music and audio products from their Shopify store, including uploading tracks and albums, configuring license terms, generating audio previews, embedding an audio player, and automatically fulfilling digital orders with secure download delivery.

Tuneboom runs inside your Shopify store and depends on your Shopify account and Shopify’s own terms. You are responsible for your store, your Shopify account, and all activity under your Tuneboom account. Billing is handled through Shopify’s billing system under the plan you select; cancelling a paid plan downgrades your account to the free tier.

You retain all ownership of the content you upload to Tuneboom — audio files, artwork, metadata, and license terms (“Merchant Content”). You represent that you own or control the rights to all Merchant Content you upload and that its sale does not infringe any third party’s rights.

You grant Tuneboom a non-exclusive, worldwide, royalty-free license to host, process, transcode, display, and deliver Merchant Content solely as needed to operate the service — for example, generating audio previews and renditions, displaying artwork in your store, and delivering files to your customers.

You additionally grant Tuneboom a non-exclusive, worldwide, royalty-free license to display Merchant Content that you have publicly published to your storefront — such as album artwork, release titles, and store name — in Tuneboom’s own marketing materials, including the Tuneboom website and App Store listing, solely to showcase work created and sold with the service.

We will never use unpublished, private, or draft content in marketing. You may opt out at any time by emailing support@tuneboom.app, and we will remove your content from our marketing materials within 14 days.

Tuneboom fulfills digital orders by generating time-limited, download-count-limited links delivered to your customers. You are responsible for the license terms you attach to your products; Tuneboom generates and delivers license documentation on your behalf but is not a party to the license between you and your customer.

You may not use Tuneboom to sell content you do not have rights to, to distribute malware or unlawful content, to circumvent plan limits, or to interfere with the service’s operation. We may suspend or terminate accounts that violate these Terms.

You can uninstall Tuneboom at any time from your Shopify admin. Upon uninstall we retain your data for a limited period to allow reinstallation, after which it may be permanently deleted. We may terminate or suspend access for breach of these Terms with notice where practicable.

The service is provided “as is” without warranties of any kind. To the maximum extent permitted by law, Tuneboom’s aggregate liability arising out of these Terms or the service is limited to the amounts you paid to Tuneboom in the twelve months preceding the claim.

We may update these Terms from time to time. If we make material changes, we will notify you through the app or by email before they take effect. Continued use of Tuneboom after changes take effect constitutes acceptance of the updated Terms.
